Definitions and key terms

In this Terms of Service, unless otherwise defined, the following terms have the following meanings:

• Cookie: small amount of data generated by a website and saved by your web browser. It is used to identify your browser, provide analytics, remember information about you such as your language preference or login information.
• Company: when this terms mention "Company," "we," "us," or "our," it refers to BePasted, that is responsible for your information under this Terms & Conditions.
• Country: where BePasted or the owners/founders of BePasted are based, in this case is Malaysia
• Device: any internet connected device such as a phone, tablet, computer or any other device that can be used to visit BePasted and use the services.
• Service: refers to the service provided by BePasted as described in the relative terms (if available) and on this platform.
• Third-party service: refers to advertisers, contest sponsors, promotional and marketing partners, and others who provide our content or whose products or services we think may interest you.
• Website: BePasted's site, which can be accessed via this URL: https://bepasted.com
• You: a person or entity that uses BePasted Services.

Restrictions

You agree not to:

• Use the Service for any illegal or unauthorized purposes.
• Share content that infringes on intellectual property rights.
• Upload malicious code or content intended to harm others.
• Attempt to circumvent any rate limiting or security measures.

Usage Requirements

BePasted does not require you to create an account to use the service. However, by using this service, you agree to the following:

• You must be at least 13 years old to use BePasted. By using BePasted, you represent and warrant that you are at least 13 years of age.
• You are responsible for all content posted and activity that occurs under you.

Content Limitations

• Each paste is limited to 2MB per tab, with a maximum of 10 tabs per paste.
• The service reserves the right to remove content that violates these terms without notice.

Privacy and Data Collection

BePasted is committed to user privacy. We do not:

• Require user registration or login
• Track or store user information beyond necessary operational data

Necessary Operational Data

For the purpose of these Terms, "necessary operational data" refers specifically to:

• Anonymized IP addresses: Used for rate limiting and abuse prevention, cryptographically hashed for privacy, and deleted after 30 days
• Technical browser information: Required for proper service rendering and compatibility
• Paste metadata: Creation time, expiry settings, and view counts needed for service functionality
• Abuse prevention data: Limited information temporarily stored to prevent spam, fraud, and malicious activity

We use SimpleAnalytics, a privacy-focused analytics service that respects your privacy:

• No cookies or tracking technologies that require consent
• No collection of personally identifiable information
• Respects "Do Not Track" browser settings
• No tracking of individual users across sessions

Additionally, we use Cloudflare Turnstile for bot protection and Arcjet for DDoS protection, both configured to minimize data collection while providing essential security. These services process limited technical data such as browser characteristics and request patterns.

We also use BetterStack for centralized logging and monitoring to ensure service reliability and security. All logs are anonymized and stripped of personal identifiers before being sent to BetterStack, and we only collect technical information necessary for maintaining and improving the service.

Service Limitations

• Rate limiting of 10 pastes per minute per IP address
• Password attempt limitations of 6 tries before being blocked for 1 minute
• Maximum paste retention period is configurable (default: 30 days) when expiration is set
• Expired pastes are archived for a configurable period (default: 90 days), then permanently deleted
• Archived pastes are not restorable or recoverable

Disclaimer of Warranties

The Service is provided to you "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, BePasted, on its own behalf and on behalf of its affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the website, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, BePasted provides no warranty or undertaking, and makes no representation of any kind that the website will meet your requirements, achieve any intended results, be compatible or work with any other software, websites, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.

Without limiting the foregoing, neither BePasted nor any BePasted's provider makes any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the website, or the information, content, and materials or products included thereon; (ii) that the website will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information or content provided through the website; or (iv) that the website, its servers, the content, or e-mails sent from or on behalf of BePasted are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components.

Some jurisdictions do not allow the exclusion of or limitations on implied warranties or the limitations on the applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to you

Limitation of Liability

BePasted shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the Service.

Changes to Terms

We reserve the right to modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the modified terms. Unless otherwise required by law, we will notify you (for example, through our Service) before we make changes to these Terms and give you an opportunity to review them before they go into effect. Then, if you continue to use the Service, you will be bound by the updated Terms. If you do not want to agree to these or any updated Terms, you can stop using the Service.
